1. Acceptance of Terms

By accessing or using the AKC Marketing Strategy Assessment platform ("Service"), operated by Amber Kinney / The AKC Collective ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

The Service provides a marketing strategy assessment quiz, scoring and recommendations based on the Scalable Growth Engine framework, metric tracking, and optional AI-powered coaching. The free tier includes the assessment, top recommendation, and metric data entry. The premium tier adds AI coaching, all recommendations, metric insights, and benchmarks.

3. Accounts and Authentication

You may sign in using Google OAuth. You are responsible for maintaining the security of your account. You must provide accurate information and promptly update any changes.

4. Premium Subscriptions

Premium features are available via a paid subscription. Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled. You may cancel at any time through the billing portal; access continues until the end of the current billing period.

Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe it was made in error.

5. AI Coaching Disclaimer

The AI coaching feature provides general marketing guidance based on the Scalable Growth Engine framework. It is not professional business, legal, or financial advice. Recommendations are generated by an AI model and may not be accurate or suitable for your specific situation. You are solely responsible for any business decisions you make.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or exploit the Service
• Share your account credentials with others
• Upload malicious content through file attachments
• Abuse the AI coaching system with harmful or inappropriate prompts

7. Intellectual Property

The Scalable Growth Engine framework, assessment content, scoring methodology, and all original materials are the intellectual property of Amber Kinney / The AKC Collective. Your quiz results, metric data, and coaching conversations remain your data — see our Privacy Policy for details.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will make reasonable efforts to notify you of material changes.
